QUESTION:

Is the Code of Ethics for Public Officers and Employees applicable to members of the Brevard Health Planning Council, a nonprofit corporation?

Your question is answered in the negative.

You have advised us that the Brevard Health Planning Council is a nonprofit, nongovernmental corporation established to provide comprehensive health planning for Brevard County by advising the area health planning council. The BHPC is empowered to raise money from the private sector and does not spend governmental funds to fulfill its purpose. The members of the council volunteer their time.

Please find enclosed a copy of a previous opinion of this commission, CEO 75-149, the rationale of which is equally applicable to your inquiry. Your question is answered accordingly in the negative.
